The Pennsylvania Telemarketing Bond is type of surety bond required by the Commonwealth of Pennsylvania, Attorney General. The surety bond is required for any business that plans to engage in telemarketing activities in the state of Pennsylvania and the bond amount is $50,000. The purpose of the bond is to protect consumers from fraudulent or deceptive telemarketing practices. If a telemarketer violates the Pennsylvania TelemarketerPennsylvania Telemarketing Bond Registration Act, the bond can be used to compensate consumers who have been harmed.

The following businesses are required to obtain a Pennsylvania Telemarketer Bond:

  • Businesses that make telephone solicitations to Pennsylvania residents for the purpose of inducing the purchase of goods or services, or to solicit contributions for a charity.
  • Businesses that use a telephone as part of a plan, program, or campaign to induce the purchase of goods or services, or to solicit contributions for a charity, when the solicitation is made from outside of Pennsylvania to Pennsylvania residents.
  • Businesses that use a telephone as part of a plan, program, or campaign to induce the purchase of goods or services, or to solicit contributions for a charity, when the solicitation is made from inside of Pennsylvania to Pennsylvania residents, and the business does not have a physical presence in Pennsylvania.

The bond will remain in effect for as long as the business is engaged in telemarketing activities in Pennsylvania. The business must renew the bond annually. If a business fails to obtain a Pennsylvania Telemarketer Bond, it may be subject to fines of up to $1,000 per day. The business may also be prohibited from engaging in telemarketing activities in Pennsylvania. Consumers who have been harmed by a telemarketer may file a claim against the telemarketer’s bond. If the claim is successful, the consumer may be able to recover their losses from the bond. If the surety company pays a claim on the bond, it will seek restitution from the bond principal (licensee).
