The Pennsylvania Telemarketing Bond is a type of surety bond required by the Commonwealth of Pennsylvania, Attorney General. The surety bond is required for any business that plans to engage in telemarketing activities in the state of Pennsylvania and the bond amount is $50,000. The following businesses are required to obtain a Pennsylvania Telemarketer Bond:
- Businesses that make telephone solicitations to Pennsylvania residents for the purpose of inducing the purchase of goods or services, or to solicit contributions for a charity.
- Businesses that use a telephone as part of a plan, program, or campaign to induce the purchase of goods or services, or to solicit contributions for a charity, when the solicitation is made from outside of Pennsylvania to Pennsylvania residents.
- Businesses that use a telephone as part of a plan, program, or campaign to induce the purchase of goods or services, or to solicit contributions for a charity, when the solicitation is made from inside of Pennsylvania to Pennsylvania residents, and the business does not have a physical presence in Pennsylvania.
The bond will remain in effect for as long as the business is engaged in telemarketing activities in Pennsylvania. The business must renew the bond annually. If a business fails to obtain a Pennsylvania Telemarketer Bond, it may be subject to fines of up to $1,000 per day. The business may also be prohibited from engaging in telemarketing activities in Pennsylvania. Consumers who have been harmed by a telemarketer may file a claim against the telemarketer’s bond. If the claim is successful, the consumer may be able to recover their losses from the bond. If the surety company pays a claim on the bond, it will seek restitution from the bond principal (licensee).

How to Register as a Telemarketer in Pennsylvania
There is no Pennsylvania Telemarketer license. Instead, telemarketers in Pennsylvania are required to register with the Pennsylvania Office of Attorney General (OAG) and obtain a Pennsylvania Telemarketer Bond.
To register with the OAG, telemarketers must submit an application that includes the following information:
- The telemarketer’s name, address, and telephone number
- The name, address, and telephone number of each principal owner of the telemarketing business
- A list of the telemarketers currently employed by the business
- A $500 registration fee
The telemarketer must also submit a Pennsylvania Telemarketing Bond in the amount of $50,000. The registration and bond must be submitted to the OAG at least 30 days before the telemarketer begins making telemarketing calls to Pennsylvania residents.
Telemarketers who are registered with the OAG must comply with the following requirements:
- They must identify themselves as telemarketers at the beginning of each call.
- They must not call consumers who have requested that they not be called.
- They must not make false or misleading statements about the goods or services they are selling.
- They must not make telemarketing calls before 8:00 AM or after 9:00 PM.
- They must not make telemarketing calls to consumers who are on the National Do Not Call Registry.
Telemarketers who violate the Pennsylvania Telemarketer Registration Act may be subject to fines of up to $1,000 per day. The telemarketer may also be prohibited from making telemarketing calls to Pennsylvania residents.
