An encroachment, as defined by the Kentucky Revised Statutes is “any improvement to land constructed, created or implemented or any change from the original contour, including but not limited to buildings, fences, ditches, embankments, driveways or signs, which hinders or prevents use or maintenance of roads or rights-of-way.” There may be times when a developer will need to get an Encroachment Permit for projects where they will encroach on a state highway right-of-way.
