What is a Brewpub in Georgia?

Brew Pub License Bond is defined as an establishment that meets ALL of the following criteria:

  1. Production and Sales:
    • Produces its own malt beverages on-site: This implies having brewing equipment and facilities on the premises where the brewing process takes place.
    • Sells the malt beverages it produces directly to consumers on-site: This means the brew pub must have a restaurant or bar area where customers can purchase and consume the brewed beverages.
  1. Sales Restrictions:
    • Derives at least 50% of its gross sales from the sale of food: This signifies that the primary focus of the establishment is food service, with brewed beverages complementing the dining experience.
    • Sells no more than 50% of its malt beverages in sealed containers off-site: This restriction limits the amount of packaged beer the brew pub can sell for take-out or purchase outside the premises.
  1. License Type:
    • Holds a Georgia Brewpub License: This specific license type is different from other alcohol licenses like brewery or taproom licenses. Obtaining this license requires fulfilling all the above criteria and acquiring the $20,000 Georgia Brewpub License Bond.

What are the requirements in order to operate a Brewpub in Georgia?

The State of Georgia defines a brewpub as an eating establishment in which beer and malt beverages are manufactured or brewed, subject to the barrel production limitation prescribed in Georgia Code Section 3-5-36 for retail consumption on the premises and solely in draft form. In order to operate a brewpub in Georgia, a Brewpub License must be obtained.

Before obtaining a brewpub license, the state requires brewpubs to first obtain a Consumption on Premises License. Once this initial license is obtained, the following application requirements must be submitted via the Georgia Tax Center website:

  1. Notarized ATT-17 Georgia Alcohol and Tobacco Personnel Statement
  2. Citizenship Affidavit which should include a government-issued photo Federal Basic Permit or Brewers Notice
  3. Scanned copy of Local License
  4. ATT-104 Brand & Label Registration and Designation of Sales Territory
  5. Power of Attorney
  6. Financial Affidavit
  7. A $1,000 license application fee
  8. A $20,000 Georgia Brewpub License Bond – this must be issued by a company licensed to operate in Georgia
