What are the requirements in order to be in the business of game promotions in the state of Florida?

A game promotion is defined as a contest, game of chance, sweepstakes or gift enterprise conducted by an operator within or throughout the state and other states in connection with the sale of consumer products and where there are chances of getting a prize.  The Department of Agriculture and Consumer Services requires that all game promotions with prizes higher than $5,000, even those based on other states but conducted in Florida and open to Florida residents, should file with the department seven days before the start of the promotions.

In order to register as a Game Promoter in Florida, you must submit the following requirements to the FDACS:

• A completed application
• Financial Security in the form of either a trust account or a Florida Game Promotion Surety Bond in the amount of $15,000
• Rules and Regulations
• $100 filing fee
