The Georgia Paid Solicitor Surety Bond is required by the Securities and Business Regulation for the state of Georgia for any entity wishing to register as a Paid Solicitor.

What are the requirements in order to be a paid solicitor in Georgia?

The Georgia Code defines a paid solicitor as a person other than a commercial coventurer who, for compensation, performs for a charitable organization any service in connection with which contributions are, or will be, solicited within or from this state. A paid solicitor shall also include any fund raising counsel who at any time has custody of contributions from a solicitation. Note: a bona fide salaried officer, employee, or volunteer of a charitable organization is not considered to be a paid solicitor.

In order to operate as a Paid Solicitor, the applicant must register with the GA Secretary of State, Securities and Charities Division. The following application requirements must be submitted:Georgia Paid Solicitor Surety Bond

  1. Completed registration application form (S-100)
  2. Payment of $250 for the initial application fee
  3. Financial statements
  4. A $10,000 Georgia Paid Solicitor Surety Bond payable to the state of Georgia (form S-100D).

What is the purpose of a Georgia Paid Solicitor Surety Bond?

This bond is required to ensure the registered paid solicitor operates in accordance with the Georgia Charitable Solicitations Act. If the paid solicitor operates outside of these regulations, a claim can be made on their Georgia Paid Solicitor Surety Bond. If settled, the surety company (the company that issues the bond) will pay out the claim. Unlike insurance however, the bond principal (the paid solicitor in this case) must repay the surety for any losses incurred from the claim.
